BIR padlocks posh burger place for undeclared sales


MANILA, Philippines - The newest gourmet burger place in Serendra in Bonifacio Global City is out of the frying pan and into the fire after the Bureau of Internal Revenue (BIR) closed it for failing to declare sales worth P4.6 million and other violations in the tax code. Murray & D’vine, which offers healthy gourmet burgers such as turkey and ostrich to seafood as well as wine, is the latest establishment shut down by the BIR. Through the commissioner's Oplan Kandado program, the BIR strictly enforces sanctions on businesses which fail to comply with tax code provisions. The tax bureau aims to padlock at least 40 erring businesses within the first semester of the year. In a statement, the BIR said Murray & D’vine used unregistered receipts or invoices, unregistered point-of-sale (POS) machines. The company failed to maintain books of accounts, to file value-added tax returns and income tax returns, and pay the corresponding tax due on the undeclared sales. Not only did Murray & D’vine failed to register with the BIR, Taguig City Revenue District Officer Gerry Dumayas said in a statement, but also used the POS machine and official receipts of another restaurant Brave Restaurant Corp. “The corporation (Murray & D’vine) even used the failure of Brave Restaurant to retire its operations as an alibi for its failure to register. These are totally unacceptable practices which we need to address with punitive actions like closure of operations and enforcement of liabilities arising from tax-related violations," he said. Makati City regional director Alfredo Misajon served the closure order issued by commissioner Sixto Esquivias IV against owner Murray Hertz. “Murray & D’vine’s failure to register its business operations with BIR after it was given the chance to comply and rectify its violations showed its total disregard of the BIR’s authority," Misajon said. A Philippine resident for 30 years, Hertz is also the part-owner of New Orleans in Bonifacio High Street that serves steaks and oysters.
