Halili sues Belo, Kho for medical malpractice

MANILA, Philippines – Nitong hapon ng Huwebes, June 18, ay nag-file ng panibagong complaint ang aktres na si Katrina Halili, kasama ang legal cousel nitong si Raymund Palad, laban kina Dr. Vicki Belo at Dr. Hayden Kho. Ito ay kaugnay pa rin ng pagkalat ng sex videos ng aktres kasama si Hayden. Unang nagtungo si Katrina sa tanggapan ng Professional Regulation Commission (PRC) kanilang alas-dos ng hapon, at dumiretso siya sa opisina ng Department of Health (DOH) bandang 2:30 ng hapon. Sa panibagong reklamong ito ni Katrina, hindi na direktang tungkol sa sex video ang laman ng kanyang affidavit laban sa dalawang medical practitioners at sa clinic na pag-aari ni Dr. Belo, ang Belo Medical Group, Inc. (BMGI). Inirereklamo ng aktres sa pagkakataong ito ay ang mismong propesyon nina Dr. Belo at Dr. Kho, kung sinunod ba ng dalawa ang specific requirements alinsunod sa Medical Rules and Regulations. Sa PRC, sinampahan ni Katrina ng "malpractice of cosmetic surgery" sina Vicki at Hayden at hinihiling nila na tanggalan ng lisensiya ang dalawang beauty doctors. Samantalang sa DOH naman ay hiniling ng aktres na tanggalan ng lisensiya at huwag nang mag-operate ang Belo Medical Group, kung saan tumatayong director si Dr. Belo. Complaint to PRC Base sa affidavit na ipinasa ni Katrina sa PRC, nakasaad dito ang mga sumusunod: "...Hayden passed the Medical Board Examination and registered with the Professional Regulation Commission on February 27, 2007. "And as admitted by Hayden in his affidavit, after passing the Board Exam for just merely 6 months, Hayden have performed liposuction on Katrina, with the date that he gave, sometime in August 2007. "For the said period of six months, Hayden could not have acquired the needed residency, training, and specialization before he could qualify as a cosmetic surgeon authorized to perform cosmetic surgery especially liposuction procedure on any patient, including Katrina. "Hayden should have undergone general surgery residency training for a period of four years with a hospital accredited by the Philippine College of Surgeons. "After the said four-year period of general surgery residency training, with specialty board certification, Hayden should also attend and complete another two years of training for cosmetic surgery, specifically for liposuction. "During the said two-year training period, Hayden could apply as a member of the Philippine Society for Cosmetic Surgery, and during this period also, the respondent should pass written and oral examinations. It is only after passing the said examinations that the respondent could be called a Diplomate. "Hayden also has the option to practice for another two years for cosmetic surgery to become a Fellow, and one of the requirements of being a Fellow is to have at least fifty (50) cases of cosmetic surgery. "Hayden now has the burden of proof to establish that he possessed all the qualifications, training, and specialization to practice cosmetic surgery, more particularly liposuction. Hayden now has to prove that he attended and passed all the written and oral examinations required of him in order to specialize in his chosen field-cosmetic surgery." Isinama rin ni Katrina sa kanyang reklamo si Dra. Belo dahil sa pagpayag niyang mag-perform ng cosmetic surgery, partikular na kay Katrina, bagamat wala pa itong sapat na " residency, training, and specialization." Ayon sa complaint ni Katrina: "Dra. Belo cannot feign ignorance on the lack of qualification, training, and specialization of Hayden as a 'cosmetic surgeon' since he only passed the Medical Board Examination sometime in February 2007 and the liposuction surgery on Katrina was done in August 2007. Thus, the Commission should also sanction and/or penalize respondent Dra. Belo to serve as a deterrent to others who might follow the practice of Dra. Belo." Nakasaad din sa complaint, na dahil tinolerate ng Belo Medical Group, Inc., "that both should be administratively found liable and guilty of malpractice of cosmetic surgery and their license to practice medicine be revoked." Complaint to DOH Sa complaint naman nila sa DOH laban sa Belo Medical Group, hinihiniling ni Katrina at ng kanyang abugado ang "immediate suspension and subsequent revocation" ng lisensiya ng naturang beauty clinic na mag-operate bilang ambulatory surgical clinics "for its failure to maintain the standards and technical requirements as provided for under Administrative Order No. 183 s. 2004, or the Rules and Regulations Governing the Licensure and Regulation of Ambulatory Surgical Clinics of the Department of Health." Ito ay may kinalaman din sa pagpayag ng BMGI na mag-perform ng cosmetic surgery "even if, as stated in the complaint, Hayden is not yet suitable and qualified." Sa pagong development na ito, malayo pa ang tatakbuhin ng kaso na ngayon ay hindi na lang tungkol sa sex video. Naririyan na rin ang pagkukuwestiyon sa kakayahan ni Hayden bilang isang professional doctor at ang pag-a-allow ni Dr. Belo at ng kanyang clinic na mag-perform ng cosmetic surgery. Kahit balik-trabaho na si Katrina sa pamamagitan ng Rosalinda, magiging abala pa rin siya dahil sa mga panibagong reklamo na isinampa niya laban kina Vicki at Hayden. - Rose Garcia, PEP.ph
