SC backs dismissal of murder raps vs Kuh Ledesma's ex-hubby


The Supreme Court has affirmed the appellate court’s dismissal of criminal charges against Luisito Gonzalez, grandson of the late President Elpidio Quirino, and his co-accused Antonio Buenaflor. Gonzalez and Buenaflor were the subjects of criminal complaints in connection with the killing of Federico Delgado and the injuries incurred by Delgado’s girlfriend, Annalisa Pesico, in March 2007. Gonzalez is the ex-husband of singer Kuh Ledesma and stepbrother of Delgado, son of shipping magnate Francisco Delgado. In a 28-page decision, the SC First Division turned down the petition filed by Delgado’s siblings seeking a reversal of the August 29, 2008 CA decision dismissing the murder charges against Gonzalez and Buenaflor. The high court said the petitioners have no legal standing in filing the petition, stressing that it is only the Office of the Solicitor General which could defend actions on behalf of the State in all criminal proceedings before the appellate courts. “Hence, the Solicitor General’s non-filing of a petition within the reglementary period before this Court rendered the assailed decision of the CA final and executory with respect to the criminal aspect of the case," the decision read. The decision was penned by Justice Antonio Carpio. Concurring with it were Justices Conchita Carpio-Morales, Teresita Leonardo-De Castro, and Lucas Bersamin. Delgado, 51, was killed on March 10, 2007 at his Manila apartment. Pesico survived the attack and positively identified Gonzalez and Buenaflor as their assailants. - GMANews.TV
