DOJ: Ruby Rose husband not yet off the hook

The husband of slay victim Ruby Rose Barrameda-Jimenez is not off the hook even if he was not included in the list of those charged for the crime, the Department of Justice said Thursday.

In a radio interview, Justice Secretary Agnes Devanadera said Manuel Jimenez III (also known as Third) would be included in the list of those charged once there is new evidence on the case.

"Ngayon, hindi ibig sabihin na dahil hindi sila kasama sa isinampa ng ating mga prosecutor, di ibig sabihin diyan e libre na sila. Any time ang ating prosecutor makakalap ng additional evidence, ito pwede muli buksan ang demanda ay maamyenda ," Devanadera told radio dzXL.

(Just because he was not included in the initial list of those recommended charged, does not mean he is off the hook. At any time if there is new evidence presented to the prosecutors, the case can be reopened and the complaint can be amended.)

She said the decision of the prosecutors was based on evidence presented before it at the time.

"Walang sapat na ebidensya so far itong laban sa asawa ni Ruby Rose. Ang nakalagay sa resolution ng fiscal, for insufficiency of evidence (There is no sufficient evidence against Ruby Rose’s husband, for now)," she said.

Why not Third?

On Monday, the DOJ filed before the Navotas Regional Trial Court murder charges against Manuel Jr., his brother Lope Jimenez, and four other alleged accomplices, namely: Manuel Montero, Eric Fernandez, Lennard Descalso, and Robert Ponce. But for lack of evidence, Third and another alleged accomplice Rudy dela Cruz were cleared of involvement in the Mafia-like killing of Ruby Rose.

Navotas fishing magnate Lope Jimenez owns Buena Suerte Jimenez (BSJ) Fishing and Trading Co., where Ruby Rose was allegedly killed.

Though they welcomed the filing of murder charges against the six personalities, the family of Ruby Rose had expressed disappointment that Third was not included in the charge sheet.

"May disappointment kami, kasi naniniwala kami na may kinalaman siya (Third) sa pagkamatay ni Ruby Rose. Nagsimula po ito sa problema nilang mag-asawa," the victim's sister, actress Rochelle Barrameda told dzBB radio in an interview Tuesday.

State witness

Barrameda said their family would file a motion for reconsideration asking the DOJ to include Third in the charge sheet.

Ruby Rose’s body was found inside a cemented steel case submerged off the Navotas Fish Port last June 10, more than two years after she had gone missing since March 2007.

The body might have never been found if a man claiming to be an accomplice to the crime - Manuel Montero - had not told authorities of the exact location of the body.

Montero will remain as an accused until the court grants his motion to be discharged as one of the suspects and be allowed to turn state witness. - GMANews.TV
