Comelec junks disqualification case vs Caloocan mayor


The Commission on Elections (Comelec) First Division on Wednesday dismissed the disqualification case lodged against Caloocan City Mayor Enrico Enchiveri by his political rival Luis “Baby" Asistio due to lack of merit. Asistio alleged that there were “discrepancies" in Echiverri’s certificate of candidacy (COC), specifically in his oath and the numbering of his notarial documents. In a nine-page resolution, the Comelec said it did not find the Caloocan mayor’s COC to be defective. Moreover, the division ruled that even if it were defective, such arguments would not be enough grounds to disqualify Echiverri. “To our mind, this is not proper ground to deny due course to or cancel respondent’s (Echiverri) certificate of candidacy under Section 78 of the Omnibus Election Code. Verily, the petition should be denied for lack of cause of action," the poll body said in its resolution. It added that Asistio did not even question Echiverri’s eligibility, only the proper notarization of his candidacy. - Kimberly Jane T. Tan, GMANews.TV
