Marcoses win back Laguna mansion from govt

The Marcos family has regained ownership of a 25-hectare property in Cabuyao, Laguna that the government had confiscated more than two decades ago.

In a 24-page resolution, the Sandiganbayan Fourth Division said the government has no valid claim over the Canlubang Mansion after it failed to include it in the list of assets that it is seeking to recover from the Marcoses.

The same resolution, promulgated last Jan. 11, also asked the Presidential Commission on Good Government (PCGG) to “return possession and control" of the property to the defendants.

“The subject property is not a subject of this suit and, thus, is not subject to reversion and re-conveyance. (T)he record shows that plaintiff has no claim over the subject property that needs to be protected. In fact the plaintiff has no actionable right over the subject property because the same is not involved in the instant case," the resolution read.

It was Ilocos Norte Rep. Ferdinand “Bongbong" Marcos, the only son of the late President Ferdinand Marcos and former First Lady Imelda Marcos, who petitioned the court for the return of Canlubang Mansion.

The PCGG seized the property in 1987, or a year after the elder Marcos was ousted from presidency through the historical EDSA People Power Revolution.

The Canlubang Mansion was among the several other Marcos rest houses turned over by the Aquino administration under the care of the Department of Tourism (DOT) in 1988 for “administration and maintenance."

Although the house and the land it is standing on were seized by the government supposedly as part of the Marcos asset it is claiming in Civil Case No. 0002, the property was not listed in the case as among the Marcos assets being claimed by the government.

Government lawyers had tried to remedy the situation by filing a “Fourth Amended Complaint" for Civil Case no. 0002, but in a resolution dated September 2, 1998, the court denied the government motion.
