Comelec urged to investigate 40 party-lists


Multi-sectoral poll watchdog Kontra Daya has asked the Commission on Elections (Comelec) to investigate nominees of 40 party-lists which supposedly do not represent marginalized and underrepresented sectors. Some government officials, police and military officials, and big-time businessmen were taking advantage of the party-list system to snag a seat in Congress, Kontra Daya said in a letter to Comelec Law Department head Ferdinand Rafanan. "We believe that it was not the intent of the law to have the powerful and influential to arrogate upon themselves the job of representing the marginalized and underrepresented," said the group. Comelec Resolution 8807 requires party-list nominees to "belong" to the marginalized and underrepresented sector, sectoral party, organization, political party, or coalition they seek to represent. Nominees need to submit proof that they advance interests of the sector — either through declarations, speeches, written articles — as well as certification that they are members of the organization 90 days prior to election day. The guidelines also require nominees to be capable of contributing to the "formulation and enactment of appropriate legislation that will benefit the nation as a whole." The two new requirements are an addition to the party-list nominee qualifications already required by the law. Party-list nominees must be

  • natural born citizens of the Philippines
  • registered voters
  • residents of the Philippines for at least one year
  • able to read and write
  • bona fide members of the party which they seek to represent for at least 90 days before the elections
  • at least twenty-five years old on the day of the election
If nominees are from the youth sector, they must be at least 25 years old but not more than thirty 30 years of age on the day of the election. The same resolution says that nominees who do not possess these qualifications may be disqualified if sought by a petitioner or by the Commission on its own, as requested by Kontra Daya. "We hope this submission and complaint will help the commission’s ongoing study and that it will be given consideration when this honorable commission exercises its motu proprio powers to disqualify a nominee or cancel the registration of a party list organization," it said.
