DOLE reminds employers on pay rules for Aug. 29, 30

With one week to go before the “long weekend," the Department of Labor and Employment reminded employers to abide by the pay rules for the holidays on August 29 and 30. Labor Secretary Rosalinda Baldoz noted that Aug. 29 is observed as National Heroes’ Day, while Aug. 30 is Eid’l Fitr – the end of the holy Islamic month of Ramadan. "Layunin ng pagdiriwang ng Pambansang Araw ng mga Bayani na ganap na parangalan ang kadakilaan, una sa lahat, ng ating mga bayani na nag-alay ng kanilang pawis, dugo, at buhay upang makamtan ang ating kalayaan, gayundin ang mga Pilipino na patuloy na nagmamahal at namumuhay ng marangal sa kapakanan ng kanilang sariling bayan at kapwa mamamayan," she said in a news release posted on the DOLE website. "(Ang Eid’l Fitr) ay sa dahilang ang ating mga kapatid na mga Pilipinong Muslim ay magdiriwang ng Eid’lFitr (Kapistahan ng Ramadhan) sa araw na ito (Eid’l Fitr is an occasion we share with our Muslim brethren)," she added. Baldoz said the following pay rules will apply on Monday and Tuesday next week, both regular holidays:

  • If the holiday falls on an employee’s regular workday: - If worked, the employee is entitled to 200 percent of his or her basic wage for the first eight hours, and for work in excess of the eight hours, to an additional 30 percent of his or her hourly rate on the said day. - If unworked, the employee is entitled to 100 percent of his or her regular daily rate, provided he or she was present or was on leave with pay on the workday immediately preceding the holiday.
  • If the day is the employee’s rest day: - If worked, the employee is entitled, for the first eight hours, to 260 percent of his or her daily rate, and for work in excess of eight hours, plus 30 percent of his or her hourly rate on the said day. - If unworked, the employee is entitled to 100 percent of his or her regular daily rate, provided he or she was present or was on leave with pay on the workday immediately preceding the holiday.
  • If the day immediately preceding the holiday is a non-work day in the establishment or the scheduled rest day of the employee, he or she shall not be deemed on leave of absence on that day, in which case he or she shall be entitled to the holiday pay. — RSJ, GMA News
