VP Binay’s camp to file charges vs judge who favored Globe Asiatique
Vice President Jejomar Binay’s camp plans to file charges against the judge who blocked the filing of a syndicated estafa case against the owner of property developer Globe Asiatique, GMA News’ “24 Oras" newscast reported Monday. Binay’s camp will file administrative and criminal cases against Pasig Regional Trial Court Branch 167 Judge Ronaldo Mislang, who issued a temporary restraining order (TRO) that stopped the Department of Justice from filing a syndicated estafa case against Globe Asiatique president and CEO Delfin Lee, the newscast said.

Binay is chairman of the state-run Pag-IBIG fund, which offers its contributing members housing loans among other financial packages. Without the TRO, Lee – whose company supposedly used fictitious buyers to secure government housing loans – could have spent time in jail since estafa is a non-bailable offense, Binay explained. “This is a judge na talagang eto ay nakakahiya na nand’yan sa judicial system. Ito ay mga sagabal doon sa programa ni Pangulong Noynoy, doon sa paglaban sa graft and corruption," Binay said in a media interview aired on “24 Oras." “For the Hon. Mislang’s failure to observe the basic laws and rules on injunction is not only inexcusable, but renders him susceptible to administrative sanction for gross ignorance of the law and incompetence," according to a copy of the complaint of Binay’s camp obtained by GMA News Online. “Indeed, Hon. Mislang may even be held criminally liable for his knowingly rendering an unjust order and causing undue injury to the government and the Pag-IBIG Fund in the discharge of his judicial functions," the complaint also said. “Disbarment ‘to, kasi irereklamo ‘yan as a judge and a lawyer," Binay added. GMA News tried to get the side of Mislang but the latter declined to be interviewed. Meanwhile, Globe Asiatique is ready to defend itself in the case, “24 Oras" said.
