Porn company accuses phone maker of trademark violation


A porn entertainment giant accused a Taiwan-based smartphone maker of violating its trademark, and wants it to stop selling the particular brand by next week.
 
Vivid Entertainment sent a cease-and-desist letter to HTC America, claiming its newest model "Vivid" infringes on its trademark, entertainment site TMZ.com reported.
 
The TMZ report said lawyers for Vivid Entertainment claimed consumers may get confused and associate the adult entertainment establishment with the phone.
 
"(HTC Vivid) creates the false impression that your company and your company’s products are affiliated, connected, or associated with and or sanctioned by Vivid Entertainment,” tech site Mashable quoted the adult movie studio's lawyer Mark Hoffman as saying.
 
Vivid Entertainment has been linked to sex tapes involving celebrities Kim Kardashian and Paris Hilton, the report noted.
 
According to the TMZ report, the letter threatened HTC with a court suit if it does not change the name of the phone by Monday, November 21.
 
On the other hand, Mashable noted that while "it’s a bit far fetched to believe consumers would confuse a smartphone with a porn studio, it is true that Vivid offers content through a variety of digital channels, including smartphones."
 
HTC has so far not commented on the matter. — TJD, GMA News
